第１条　本規約の範囲及び変更

本サービスを利用する場合、本規約に同意したものと見なします。本規約の全てに同意しないと、本サービスをご利用できない。

当社は、利用者に事前通知することなく、本サービスの内容を変更することができるものとします。本サービスを使用することで、利用者は、いかなる改訂にも拘束されることに同意したものとみなされるので、定期的にこのページを閲覧し、利用者が拘束される最新の条項をご確認ください。

 

第２条　利用者　

「利用者」とは、本サービスの閲覧、購入などの利用を行う方をいいます。

未成年の利用者は、適格な法定代理人の事前の同意を得なければ、本サービスを利用することができません。

 

第３条　個人情報

本サービスの利用に関連して当社が知り得た利用者の個人情報については、当社は別途当社が定める「プライバシーポリシー」に従い取り扱うものとします。

 

第４条　本サービスの保守

当社は、本サービスの稼動状態を良好に保つため、以下各号の何れかに該当する場合には、 利用者に事前に通知を行うことなく、一時的に本サービスの提供の全部又は一部を停止又は中止することができるものとします。

（１）本サービス提供のためのコンピューターシステム（以下「システム」といいます）の定期保守及び緊急保守の場合

（２）火災、地震、洪水、落雷、大雪等の天変地異により、システムの運用が困難になった場合

（３）戦争、内乱、テロ、暴動、騒擾等の社会不安により、システムの運用が困難になった場合

（４）その他、止むを得ずシステムの停止が必要と当社が判断した場合

 

第５条　パスワードの管理

利用者は、自身で設定したパスワードの管理責任を負うものとします。

利用者は、パスワードを第三者に譲渡または貸与し、もしくは第三者と共用することはできません。パスワードが第三者によって不正に使用されていることが判明した場合には、直ちに当社に連絡するものとします。

 

第６条　知的財産権

本サービスを通じて提供されているコンテンツ（文字、グラフィック画像、ロゴ、写真、ビデオなど）の知的財産権はOneFish.shopが保有しています。また、本サービスを通じて提供されている写真に使用されているモデル、タレント、個人の肖像権はそのモデル、タレントの所属事務所または個人が保有しています。利用者はこれらの権利を侵害する行為を行わないものとします。

本条の規定に違反して第三者との間で何らかの紛争が生じた場合、利用者はその責任と費用において、かかる紛争を解決するとともに、当社に何らの損害、損失又は不利益等を与えないものとします。

第７条　商品等の購入

利用者は、本サービスを利用して当社から商品および付帯サービス（以下「商品等」といいます）を購入することができます。当社は注文確定後30分以内に注文内容をメールでお送りして承諾の通知とし、これをもって売買契約の成立とします。

発送前に注文の変更やキャンセルは可能ですが、発送しましたら変更とキャンセルはできません。

ご注文受付後、約 4- 7営業日以内に発送いたします。（祝日除く）発送しましたら伝票番号をメールでお通知致します。発送後、約3－5営業日以内にお届けます。（天候や交通状況・休日をはさむ場合はお届け予定日を過ぎる場合がございます） 

第8条　商品等の返品

以下の場合は返品はお受けできませんのでご注意ください。

（１）商品到着日より7日以上

（２）一度開封し、ご使用になったり、ご使用形跡のある商品

（３）ご試着により香水、タバコ、その他においが付着したり、商品にキズや汚れ、糸のほつれ、変形など破損が生じた場合

（４）クリーニングや洗濯されたり、裾直し等の加工がされた商品

（５）パッケージ（袋、ケース、タグ）や付属品のない商品

（６）オークション商品、セール対象の商品

（７）衛生のために、アンターウェアとストックは返品できません

（８）写真とイメージが違う、思った色と違うなどのお客様都合によるもの

（９）間違った商品を注文してしまったなどのお客様都合によるもの

（１０）事前にご連絡いただいていない場合

 

第9条　禁止事項

本規約で規定される内容以外、利用者は以下の行為を行ってはならないものとします。

（１）犯罪行為、公序良俗に反する行為、その他法令に違反する行為、またはその恐れのある行為

（２）他の利用者、他の利用者以外の第三者、若しくは当社に迷惑、不利益若しくは損害を与える行為、又はそれらのおそれのある行為

（３）虚偽の登録内容を申請する行為

（４）転売、再販売、その他営利を目的として本サービスにより商品を購入する行為

（５）他人の個人情報を集めるまたは追跡する行為

（６）当社および当社関連会社の所有する知的財産権を侵害する行為

（７）その他、当社が不適当と判断する行為

 

第１0 条　その他免責事項

（１）利用者は、当サービスを利用するのに必要なコンピュータ機器や通信機器等の準備、設置に関する費用、当サービスを利用するために要した電話料金、インターネット接続料金、回線利用料等の通信料金、その他一切の費用を負担するものとします。

（２）当社は、利用者のパスワードの変更等を行う場合、当社指定の方法で本人確認を行うことにより免責されるものとします。

（３）当社は、天変地異または社会不安が生じた場合に、一時的に本サービスが停止、中止又は変更されたとしても、利用者が直接的又は間接的に被った一切の損害、損失、不利益等について、いかなる責任も負わないものとします。

（４）当社は、配送先不明等によるトラブルに関しては、利用者が登録している連絡先に連絡し、注文の際に利用者が指定した配送先に商品等を配送等することによって商品等の引渡債務を履行し、当該債務から免責されるものとします。

（５）利用者が、本サービスご利用することで、第三者に対して損害等を与えた場合には、当該利用者は自己の責任と費用において解決し、当社には一切迷惑をかけないものとします。

（６）当社は、法律上の請求原因如何を問わず、本サービスの利用に関して当社の責めに帰すべからざる事由から利用者に生じた損害、損失、不利益等について責任を負わないものとします。

 

第１1 条　その他

当サービスのご利用に関して、本規約により解決できない問題が生じた場合には、利用者と当社は、双方誠意をもって話し合い、これを解決するものとします。

準拠法
これらの利用規約および弊社がお客様にサービスを提供するための個別の契約は、北アイルランドの法律に準拠し、同法に従って解釈されるものとします。
